According to a report, a Louisiana judge has temporarily reversed his decision to give the man full custody of the 16-year-old girl who was conceived after he allegedly raped her mother in 2005.
During a Tuesday hearing, Judge Jeffrey Cashe handed the youngster over to a guardian until a July 15 hearing to see who will get custody, according to WBRZ.
Last week, Crysta Abelseth said her daughter's father, John Barnes, raped her when she was 16 after picking her up at a bar.
According to Abelseth said that Barnes, who was 30 years old at the time of the assault, raped her. She subsequently gave birth to a girl who is now 16 years old, according to KFYR-TV.
Barnes reappeared into the picture five years later, according to court documents. After Judge Cashe took over the case, a split-custody agreement was reached in 2015.
In March, a judge granted Barnes full custody. As part of the decision, Abelseth was ordered to pay child support to Barnes, a businessman who owns Gumbeaux Digital Branding.
He says the allegations against him are false, and he has stated to Fox News that "I had no idea she was 16, and I didn't rape her."
After she learned it was within the statute of limitations, Abelseth now 32, filed a formal complaint regarding the alleged assault in 2005.
“I felt like if I didn't do it the next day, there was nothing I could do about it,” she said of why she delayed contacting authorities. “He [the trauma therapist] told me that there is no statute of limitations on assault.”
The allegations weren't properly looked into, according to the sheriff of Tangipahoa Parish Daniel Edwards, who acknowledged there was a "lack of leadership" from his department seven years ago.
“It was an accident, not a conspiracy,” Edwards said to WBRZ. “I feel sorry for Crysta that occurred. But I want the public to understand that this was not deliberate and intentional negligence.”
In February, documents filed in the custody battle alleged for the first time that the 16-year-old girl was raped and charged Barnes of drugging and raping her as well, according to WBRZ. He has denied all of those charges.
The girl was brought to New Orleans, where it was determined that she had been sexually assaulted, according to the lawsuit. However, the judge dismissed Abelseth's claims of rape and other allegations.
Tuesday's decision to take custody away from Barnes was praised by Abelseth, who now has a pro bono attorney as a result of her claims on WBRZ.
“People should be held accountable,” Ambeau told WDRB. “The system failed everyone here. When that occurs, the system must be held responsible, and we intend to do so.”
Barnes has not been charged with a crime.
“It's a lie,” he stated on Monday. “She was in a bar with a phony identification, claiming to be a college student. I had no idea she was 16, and I did not assault her. That is completely untrue.”
The age of consent in Louisiana is 17.
The decision to give Barnes custody of the child and order Abelseth to pay child support has been widely criticized, with many people calling it an example of how the justice system fails rape victims.
Abelseth's story highlights the difficulties that rape victims can face in getting justice, especially when they are minors. In many states, including Louisiana, the statute of limitations for rape is just three years, which means that many victims are unable to press charges because they do not come forward until after the deadline has passed.
