New York City employees who were terminated for not getting vaccinated must be given their jobs back with full compensation, as per a ruling from the state Supreme Court.
On Monday, the court ruled that "vaccines do not stop a person from contracting or spreading COVID-19." Earlier this year, New York City Mayor Eric Adams said that his administration would not give their jobs back to employees who had been let go because they refuse to get vaccinated.
Earlier this year, after the city adopted a vaccine mandate under former Mayor Bill de Blasio, New York City fired nearly 1,700 employees for not being vaccinated. Out of those fired, many were police officers and firefighters.
The city has argued that the mandate is necessary to protect public safety, but the Supreme Court disagreed. In its ruling, the court said that "the record fails to establish that unvaccinated employees pose a direct threat to the health or safety of others."
Earlier this year, after the mayor allowed athletes and performers to get an exception from the vaccine mandate while firefighters were still getting fired for their status, both FDNY-Uniformed Firefighters Association President Andrew Ansbro and FDNY-Uniformed Fire Officers Association President Lt. James McCarthy spoke out against Adams. The duo demanded that the city broaden the exception to include all New Yorkers.
"The mayor's double standard is reprehensible and an insult to the men and women of this department who have put their lives on the line day in and day out," Ansbro said in a statement.
According to the mayor, NYC will not rehire unvaccinated workers.
"We're in support of the mayor's announcement to revoke the vaccine mandate that was announced on Thursday," McCarthy said. "We think that it should be extended as well. We work with athletes and performers in New York City, so we support the revocation of the mandate." The people who work for New York City should have the option to relocate as well.
"The decision to rescind the vaccine mandate is an important step in returning our city to some sense of normalcy," said Sarah Kate Ellis, president and CEO of GLAAD. "New Yorkers have a right to live and work without fear of losing their jobs if they do not want to take a vaccine."
"This is good news for the workers of New York City," said Stuart Appelbaum, president of the Retail, Wholesale and Department Store Union. "The city's decision will allow them to continue working without the fear of losing their job if they do not want to take the vaccine."
Ansbro stated that if the city is to remove the vaccine mandate for certain individuals, then they need to remove it for everyone. If they are going to follow science, then they would know that there is no danger at present and removing hundreds of firefighters', police officers', and other emergency workers' jobs would not be in the best interest of the city--it's unsafe.
"This is a huge victory for our hard-fought campaign to ensure that all New Yorkers have the right to refuse the Covid vaccine without fear of losing their job," said Michael Mulgrew, president of the United Federation of Teachers. "The city's decision will allow them to continue working without the fear of losing their job if they choose not to receive the vaccine."
